On June 15, 2020, the Supreme Court issued a landmark decision holding that Title VII of the Civil Rights Act of 1964 prohibits discrimination against employees and applicants on the basis of gender identity and sexual orientation. This historic ruling comes during a time of renewed attention on the rights of LGBTQ+ employees. Earlier this month, the U.S. Department of Health and Human Services (HHS) completed its final rule implementing Section 1557 of the Affordable Care Act, revising the agency’s interpretation of the section and removing certain protections previously provided under it, and prompting a response from Gov. Andrew Cuomo affirming that benefits discrimination based on gender identity or sexual orientation is illegal under New York law.
